Catering Terms

 

 

DEPOSIT & CANCELLATION POLICY:

A DEPOSIT OF 50% OF THE TOTAL ESTIMATED AMOUNT IS NEEDED TO CONFIRM THE BOOKING OF THIS EVENT. IF FOR ANY REASON YOUR PARTY CANCELS WITHIN 30 DAYS OF THE EVENT, WE WILL RETURN 50% OF YOUR DEPOSIT. IF FOR ANY REASON YOUR PARTY CANCELS WITHIN 10 DAYS OF YOUR EVENT, NO DEPOSIT MONIES WILL BE RETURNED.

FINAL PAYMENT:

CLIENTS BALANCE IS DUE TWO WEEK PRIOR THE EVENT. We accept credit cards, Money orders, cashier’s checks and cash.

TAXES

CLIENT will be charged the applicable current rate for all services rendered as determined by the City of Chicago and/or State of Illinois.

GUARANTEES ON NUMBER OF GUESTS:

Food, beverage and add-on items charges based on guest count will be based on the Client’s final guarantee. Final guest counts are due no later than one week before the date of the event. If no final guest count is received, we will use the number of guests used in the attached proposal. If the guaranteed guest count falls below 75% of the proposal guest count, the price per guest may be increased. We will make every effort to accommodate any last minute increases in the guest count.

LEFTOVERS

In accordance with appropriate Health Codes, Norman’s Bistro Elite Catering reserves the right to discard any leftover food items, after the agreed upon event timetable, where there is a reasonable risk for food borne illness to occur.

ALCOHOL SERVICE:

Our Company will exercise the right to refuse servicing alcohol to any guest who is intoxicated, or individuals not of legal drinking age.  Due to insurance regulations and liquor license stipulations we cannot leave alcoholic beverages at our departure.

DAMAGE

Norman’s Bistro Elite Catering assumes no responsibility for ANY damage or loss of merchandise, alcohol, equipment, furniture, clothing or other valuables prior to, during or after the event. Norman’s Bistro Elite Catering will do everything possible to ensure that all of CLIENT’s supplies, rentals and equipment are cared for and maintained in good working order and without damage.

 

When providing the location for the event/function, the CLIENT, understands that accidents/breakage and/or damage may sometimes occur. Norman’s Bistro Elite Catering will not be liable for any damage or loss, unless specifically caused by the willful negligent actions or conduct of Norman’s Bistro Elite Catering or its employees.

ASSIGNABILITY

This contract is not assignable without the prior written consent from Norman’s Bistro Elite Catering.

CANCELLATION BY CATERER

Norman’s Bistro Elite Catering reserves the right to terminate this contract for ANY REASON it deems valid.

CATERER LIABILITY:

CLIENT absolves Norman’s Bistro Elite Catering from any third party claims, except for actions caused by Norman’s Bistro Elite Catering and/or negligence of its employees. Such claims to amount to a maximum amount of USD Two hundred ($ 200.00) only.

STAFFING:

Our staff will be dressed in black unless you request something different. Our proposal includes staffing for up to 4 hours beginning at the starting time through final cleanup of the event. Overtime is billed at the rate of $20.00 per hour. No overtime will be incurred if the event ends on schedule. We reserve the right to increase or decrease the number of staff if the guaranteed guest count is 10% higher or lower than the number included in this proposal.

HOLIDAY PAY:

Time and a half staff rates apply for:  new year’s day, memorial day, 4thof July, labor day, thanksgiving, Christmas day, Christmas eve and new year’s eve.

LIABILITY:

It is understood that the client take full responsibility for the action of the guests at all times during the event and will conduct the event in compliance with all applicable laws, ordinances and regulation, and the necessary facility contract.  Your party agrees to be responsible for any damage done to the premises or any other PARTS of an event facility during the period of time your party and anyone related to your party is in the facility.  Both parties agree that our catering company’s liability for performance is expressly limited to the amount of fees paid by client for services described herein.  

 

This agreement shall be interpreted by and enforced in accordance with the laws of the State of Illinois and is not assignable. If the client consists of more than one person or entity, the liabilities of all such persons or entities hereunder shall be joint and several.  Catering services will not be rendered until a copy of the agreement has been signed and returned to our company with applicable deposit.
